The RCFCA is governed by two documents, the Covenants and Restrictions and By-Laws.
Each resident of the community receives both documents prior to closing on a property in the community via the 5407 process.
The C&R is dated March 30, 1993 by TJEM, and was recorded in Chester County, PA on April 6, 1993. Later, TJEM sold the community to Toll Brothers who subsequently donated the land on the west side of Route 100 to The Brandywine Conservancy, and gave The Brandywine Conservancy the ability to oversee our open space should the Association fail to do so (First Amendment to the C&R). The documents regarding the transfer of property to Toll Brothers, the release of TJEM's rights, and the transfer of property to The Brandywine Conservancy are not available on this site but can be obtained at the Recorder of Deeds office in Chester County.
The C&R specifies, in section 8, what is and what is not permitted in the community. This includes the following:
The First Amendment specifies that the Association has the authority and obligation to protect the open space, and that The Brandywine Conservancy has the right to ensure that the Association has done so, and to take action should the Association fail to do so.
The By-Laws of the Association were also created by TJEM. On February 26, 1998 they were amended, and on March 22, 1999 the Association voted to again amend the By-Laws. The specific legal language for the numerous 1999 changes was not incorporated into the By-Laws until the 2002-2003 board undertook the task and working with legal counsel completed the work in the first quarter of 2003. At the April 6, 2003 Board Meeting these changes were read into the minutes and formally became part of the By-Laws as per our legal counsel's recommendation.
